California Privacy Rights

If you are a California resident, you have certain rights with respect to your personal information. Those rights and how you may exercise them are described below.
This notice supplements Ariat’s GeneralPrivacy Policy, which we encourage you to read.
Shine the Light
California Civil Code Section 1798.83 permits Ariat customers who are California residents to request certain information regarding and/or opt-out of our disclosure of personal information to third parties for their direct marketing purposes. Please note, that as a user of the service, you cannot opt-out of some administrative communications that are reasonably necessary to the service, such as billing or service notifications.
California Consumer Privacy Act (CCPA)
The California Consumer Privacy Act of 2018, as amended by the Califorina Privacy Rights Act (collectively, the “CCPA”), provides you with the right to: (a) request knowledge of/access to the personal information collected about you in the previous 12 months (the “Right to Know”); (b) request deletion of your personal information (the “Right to Delete”); (c) request correction of inaccurate personal information (the “Right to Correct”); (d) request that a business limit how its uses or discloses your “Sensitive Personal Information,” as defined under the CCPA (the “Right to Limit”); and (e) request that a business that “Sells” or “Shares” your personal information, as defined under the CCPA, stop Selling or Sharing it to third parties (the “Right to Opt-Out”). In addition, you have the right not to receive discriminatory treatment by a business for exercising those rights.
These rights are subject to certain exemptions and exceptions as well as certain steps that must be taken to verify your identity.
Right to Know
You may request that we provide you with: (i) a list of the categories of personal information and/or specific pieces of information we have collected about you within the past 12 months, (ii) the categories of sources from which it was collected, (iii) the purpose for collecting, disclosing, Selling or Sharing the information, (iv) the categories of “third parties” to whom we disclosed, Sold or Shared that information, and (v) the categories of information that the business Sells of discloses to third parties. You may make a Request to Know up to two times in a 12-month period, subject to verification limitations described in the CCPA. Our method for verifying any particular request weighs information we receive as part of the request, the sensitivity of the consumer information at issue, and the risk of harm to the consumer from unauthorized disclosure.
Depending on the nature of your interactions with us, we may have collected some or all of the following categories of personal information about you within the past 12 months:
- “Identifiers,” such as first and last name, shipping address, billing address, email address, phone number, user name, signature, IP address, cookie ID, browser or device identifier and similar information.
- “Financial Information,” such as payment card information.
- “Demographic Information,” such as age or gender. Demographic information may include characteristics of protected classifications under applicable law.
- “Device or Browser Information,” such as device or browser type and configuration
- “Location Information,” such as your approximate location when you access the Site
- “Commercial Information,” such as your shopping or purchasing history on our Services
- “User Content,” such as comments or other content posted to our Site or shared with us via email, browsing activity, or social media content
- “Internet Activity” or “Usage Data,” such as information about how you use a Service or interact with marketing communications sent on our behalf
- “Profile Information,” which is inferences we make about your interests for marketing or other commercial purposes based on other types of Personal Information we collect about you

Right to Correct or Delete
You may request that we correct any inaccurate personal information that we have collected from you.
You may also request that we delete any personal information that we have collected from you. However, the law exempts certain information from deletion. For example, we may keep information necessary for security and fraud detection. We also may keep information needed to provide you goods or services. When we respond to your request to delete, we will explain what (if any) information we have kept and why. Please note that we may “delete” your information by anonymizing, aggregating, or pseudonymizing it.

Right to Limit Use and Disclosure of Sensitive Personal Information
Ariat may collect Sensitive Personal Information to the extent that you seek assistance from Customer Service via our website’s chat feature. Any such information will be collected with your consent and voluntarily provided by you. Sensitive Personal Information that may be collected include your email address, or health information. Ariat does not sell or share Sensitive Personal Information
You have the right to request that Ariat limit its use and disclosure of your Sensitive Personal Information, if any, to that use and disclosure which is necessary to perform the services or provide the goods reasonably expected by an average consumer who requests such goods and services. Ariat does not collect Sensitive Personal Information for the purpose of inferring characteristics about you . We retain personal information we collect from you where we have an ongoing legitimate business need to do so (for example, to fulfill your orders or to comply with applicable legal, tax, or accounting requirements). When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymise it or, if this is not possible, (for example because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

Right to Opt-Out of the “Sale” or “Sharing” of Personal Information
Under the CCPA, you may request to opt-out of the “Sale” of your personal information—which the CCPA defines very broadly to include some transactions or arrangements that do not involve the exchange of data for money—and the “Sharing” of your personal information, which the CCPA defines as sharing with third parties for purposes of cross-site targeted advertising. We do not sell personal information in any traditional sense, but we do provide some partners (including some providers of third party cookies) with access to personal information for marketing-related purposes, which may be considered Selling or Sharing with those partners under the CCPA.

Right to Non-Discrimination
Ariat does not discriminate against customers who exercise their rights under applicable privacy law. We will not deny you goods or services, charge you different rates, or give you different discounts because you exercised one of these rights.
How to Make a Request
To submit a Request to Know, Delete, Limit the Use or Disclosure of Sensitive Information, Correct or Opt-Out, click the “Your Privacy Choices” link at the bottom of our Website’s homepage. Alternatively, you may contact us to make any requests related to your personal information by sending an email to compliance@ariat.com. When you make a request, we may take steps to verify your identity before responding. This is to protect your information. Our method for verifying any particular request weighs information we receive as part of the request, the sensitivity of the consumer information at issue, and the risk of harm to the consumer from unauthorized disclosure
If you are submitting a request on behalf of another consumer as their authorized representative, you must include the foregoing information about the consumer and provide proof of permission from the consumer to make the request.
After confirming receipt of your request, we’ll contact you if we need more information in order to verify it. If we can’t verify a request, we may deny it.
Notice of Financial Incentive
We offer our customers a loyalty program (the “Ariat Insider Program”) that provides certain perks, such as rewards and exclusive offers. We may also provide other programs, such as sweepstakes, contests, or other similar promotional campaigns (collectively, the “Programs”). When you sign up for one of these Programs, we typically ask you to provide your name and contact information (such as email address and/or telephone number). Because our Programs involve the collection of personal information, they might be interpreted as a “financial incentive” program under California law. The value of your personal information to us is related to the value of the free or discounted products or services, or other benefits that you obtain or that are provided as part of the applicable Program, less the expense related to offering those products, services, and benefits to Program participants.
You may withdraw from participating in a Program at any time by contacting us using the designated method set forth in the applicable Program Terms and Conditions.
Minors
We do not knowingly collect personal information from children under 16. If you are a parent or guardian and you are aware that any of your children have provided us with personal information without your consent, please contact us and we will take steps to remove that information.
Browser Privacy Signals
If you have configured your browser to send a Global Privacy Control (GPC) signal, we will interpret that signal as your Request to Opt-Out of cookies on our Website that may involve a Sale or Sharing of your personal information. You can learn more about GPC here: https://globalprivacycontrol.org/
“Do Not Track” is a privacy preference that users can set in their web browsers. Please note that many web browsers support Do Not Track technology. If you enable “Do Not Track,” the browser may send a message to websites requesting them not to track the user. Changes To This Policy
We reserve the right to update or change our California Privacy Policy and our General Privacy Policy at any time and you should check this California Privacy Policy and our General Privacy Policy periodically.
